Why investors in Malaysia look at UK property

Every buyer's reasons are their own. These are the practical points that shape a UK purchase from Malaysia.

Published rules on investing abroad

Under Bank Negara Malaysia's foreign exchange policy, a resident individual without domestic ringgit borrowing may invest in foreign currency assets up to any amount. With such borrowing, limits apply, set out below.

An agreement since 1998

The UK and Malaysia double taxation agreement has been in force since 8 July 1998, amended by a protocol in force from 28 December 2010.

A sterling asset

A UK property is priced and let in pounds. Its cost and value in ringgit move with the exchange rate, which is worth understanding before you commit.

Ownership of land and property in England and Wales is registered by HM Land Registry, and most stages of a purchase can be handled remotely. PROXERA Wealth works across buy-to-let, below-market-value, new homes and off-plan, and short-term lets. See the current developments or our guide to investing in UK property.

This guide is for people living in Malaysia. If you are a Malaysian citizen living elsewhere, the UK rules follow where you live: see, for example, our guides for investors in Singapore and Hong Kong. We also have guides for mainland China, Saudi Arabia, Qatar and Kuwait, and every country guide is listed on our overseas investors page.

One plan. Every UK moving part connected.

What each buyer needs varies by country, lender and how they buy. Our job is to keep the whole journey joined up, so you are never coordinating it from Malaysia on your own.

The UK taxes that apply when you live in Malaysia

Living in Malaysia does not take a UK property out of the UK tax system. These are the rules for the 2026 to 2027 tax year, checked on 23 October 2026.

Stamp Duty Land Tax when you buy

Stamp Duty Land Tax (SDLT) applies to residential purchases in England and Northern Ireland. Scotland and Wales have their own taxes, and the non-UK resident surcharge does not apply there. Two surcharges stack on the standard rates:

  • Higher rates for additional properties, 5%. Added to every band if, after the purchase, you will own more than one residential property worth £40,000 or more anywhere in the world. A home in Malaysia counts.
  • Non-UK resident surcharge, 2%. Added if you have not been present in the UK for at least 183 days in the 12 months before the purchase, on top of all other residential rates.
Portion of the priceStandard rateAdditional propertyAdditional property, non-UK resident
Up to £125,0000%5%7%
£125,001 to £250,0002%7%9%
£250,001 to £925,0005%10%12%
£925,001 to £1.5 million10%15%17%
Above £1.5 million12%17%19%

A worked example: an investor living in Malaysia who already owns a home there buys a £250,000 buy-to-let in England. SDLT is £20,000, of which £5,000 is the non-resident surcharge. A UK resident buying the same additional property would pay £15,000.

If all the buyers spend at least 183 days in the UK in a continuous 365-day period that starts no more than 364 days before completion and ends no more than 365 days after it, the surcharge may be reclaimable within 2 years. Your conveyancer usually files the SDLT return and pays the tax within the 14-day deadline after completion. Companies generally pay the higher rates, and a 17% rate can apply to company purchases above £500,000. Estimate your figure with the stamp duty calculator, and read our guides to stamp duty for non-residents, stamp duty on second homes and limited company buy-to-let.

Tax on your rent: the Non-Resident Landlord Scheme

HMRC classes you as a non-resident landlord if you live abroad for 6 months or more a year. Your letting agent must then deduct basic rate Income Tax from the rent, after the expenses they pay, and pass it to HMRC each quarter. With no agent, a tenant paying more than £100 a week must deduct it. To receive rent without deduction, you apply on form NRL1, and HMRC will not approve it if your UK taxes are not up to date. Either way, you declare the rent on a UK Self Assessment return unless HMRC tells you not to. Our guide to the Non-Resident Landlord Scheme covers how it runs in practice.

Income Tax on your rental profit

Income Tax is charged on your rental profit: the rent less allowable expenses such as agent fees, insurance and repairs. An individual landlord cannot deduct mortgage interest; relief for residential finance costs is restricted to the basic rate, and this applies to non-UK residents. For 2026 to 2027 the rates are 20% from £12,571 to £50,270, 40% to £125,140 and 45% above. Living abroad, you get the £12,570 Personal Allowance if you are a British or EEA citizen, have worked for the UK government in the tax year, or the double taxation agreement with your country of residence provides for it.

From 6 April 2027, property income has its own rates of 22%, 42% and 47% (Finance Act 2026, section 7), and the government's technical note says Non-Resident Landlord Scheme deductions and finance cost relief move to the 22% property basic rate. GOV.UK says non-resident landlords cannot use HMRC's own online services for their return, so it is filed with commercial software, on paper by 31 October, or through an accountant. Model your figures with the landlord tax calculator.

Capital Gains Tax when you sell

Living abroad does not take a sale of UK property or land out of UK tax. For individuals in 2026 to 2027, Capital Gains Tax is 18% on gains within the basic rate band and 24% above it. You report the sale through a Capital Gains Tax on UK property account and pay any tax within 60 days of completion, even if there is no tax to pay or you made a loss; late reports can bring interest and penalties. Non-UK resident companies pay Corporation Tax on these gains instead. Try the capital gains tax calculator.

Inheritance Tax on UK property

Since 6 April 2025, Inheritance Tax depends on residence rather than domicile. If you have been UK resident for the previous 10 consecutive years, or 10 or more of the previous 20, you are a long-term UK resident and assets outside the UK can be in scope. If not, Inheritance Tax applies only to your UK assets, which include UK property, at 40% on the part of an estate above the £325,000 threshold.

Malaysia is not among the countries GOV.UK lists as having a double taxation convention that applies to Inheritance Tax, so there is no treaty relief for Inheritance Tax between the two. An adviser can explain how an estate that includes UK property would be treated in both places.

The UK and Malaysia double taxation agreement

The UK and Malaysia double taxation agreement was signed in Kuala Lumpur on 10 December 1996 and entered into force on 8 July 1998, with UK effect for Income Tax and Capital Gains Tax from 6 April 1999. A protocol signed in London on 22 September 2009 entered into force on 28 December 2010, with effect for tax years beginning on or after 1 January 2011. It replaced the article on exchange of information and a paragraph on persons entitled to special tax benefits.

What the articles we have read, in GOV.UK's text of the agreement as amended by the 2010 protocol, say about UK property:

  • Rental income, Article 6. Income a Malaysian resident derives from immovable property in the UK, including from letting it, may be taxed in the UK.
  • Gains, Article 14. Gains a Malaysian resident makes on selling UK immovable property may be taxed in the UK. So may gains on shares deriving their value or the greater part of their value directly or indirectly from UK immovable property, other than shares quoted on an approved stock exchange, and on interests in partnerships or trusts whose assets consist principally of UK immovable property. Either country may also tax someone who was resident there at any time in the 5 years before a sale.
  • Relief, Article 24. Subject to Malaysian law on credit for foreign tax, UK tax payable on income a Malaysian resident derives from the UK is allowed as a credit against Malaysian tax on that income, capped at the part of the Malaysian tax attributable to it.

In short, the agreement confirms the UK's right to tax your UK rent and gains, and sets out how Malaysia gives credit for UK tax. How Malaysia taxes your UK income is a question for a Malaysian adviser. We have not summarised the other articles of the agreement.

Currency, mortgages and the checks to expect

Currency

Your deposit, completion funds and any mortgage payments are in sterling, while your income and savings may be in ringgit. The sterling cost of each payment depends on the exchange rate on the day you convert.

Malaysian foreign exchange rules

Funds leaving Malaysia follow Bank Negara Malaysia's Foreign Exchange Policy Notices, in the version in operation from 1 October 2025. Notice 3, Investment in Foreign Currency Asset, sets the limits for resident individuals, including for real estate outside Malaysia:

  • Without domestic ringgit borrowing. A resident individual may invest in foreign currency assets up to any amount.
  • With domestic ringgit borrowing. The limit is RM1 million equivalent per calendar year from converted ringgit, a trade foreign currency account and certain asset swaps, counted together with any sole proprietorship or general partnership you own.
  • Outside that limit. Foreign currency funds sourced from outside Malaysia, other than export proceeds, may be invested in any amount. So may real estate abroad bought for your own or an immediate family member's accommodation, for education, employment or migration.
  • What counts as borrowing. Domestic ringgit borrowing is ringgit borrowing from another Malaysian resident. Bank Negara Malaysia's FAQ says one housing loan and one vehicle loan are excluded, and that more than one of either counts.

Bank Negara Malaysia says transactions outside these rules need an application to it first, and banks in Malaysia may ask for supporting documents as part of their due diligence. Check the current position with your bank before you commit.

Exchange-rate movements change the true sterling cost of your deposit and completion funds, so when and how you convert matters. Where appropriate, we can introduce a specialist foreign-exchange provider. Our guide to currency and international payments explains the moving parts.

Mortgages while living in Malaysia

Some UK lenders offer buy-to-let mortgages to UK expats and to foreign nationals living overseas, each with its own criteria. What is available depends on your country of residence, income currency, deposit, circumstances and the property. An FCA-authorised mortgage broker can review your options early, and lending is subject to eligibility, valuation and lender approval. Read our expat mortgages guide and our buy-to-let mortgages guide for how the lending works.

Identity and source of funds checks

UK property transactions fall under the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017. Estate agents, letting agents on higher-value lettings (regulation 13) and solicitors acting on property sales and purchases (regulation 12) must identify you and verify your identity (regulation 28). Verification can rely on a secure electronic identification process (regulation 28(19)), which is how much of it is done remotely. Where risk is higher, enhanced due diligence applies (regulation 33), and HMRC guidance for estate agency businesses says this includes verifying source of funds and source of wealth. Expect to evidence where your deposit and purchase money come from. Lenders and banks run their own checks too.

Working with London from Malaysia

The National Metrology Institute of Malaysia describes Malaysian Standard Time as Coordinated Universal Time plus eight hours, based on longitude 120° East. London is on GMT (UTC) in the UK winter and one hour ahead during British Summer Time. So Malaysia is 8 hours ahead of London in the UK winter and 7 hours ahead in the UK summer.

UK clocksDatesWhen it is 9am in London, in Kuala Lumpur it is

Buying from Malaysia: common questions

Do I pay extra stamp duty if I live in Malaysia?

Usually, yes. If you were present in the UK for fewer than 183 days in the 12 months before buying in England or Northern Ireland, a 2% surcharge is added to every band. If you will own more than one residential property worth £40,000 or more anywhere in the world, including a home in Malaysia, the 5% higher rates apply as well. Your conveyancer confirms the final figure.

Is there a tax treaty between the UK and Malaysia?

Yes. The UK and Malaysia double taxation agreement was signed on 10 December 1996 and entered into force on 8 July 1998, and was amended by a protocol in force from 28 December 2010. It allows the UK to tax income and gains from UK property, and provides for UK tax to be credited against Malaysian tax on the same income, subject to Malaysian law.

Do Malaysian rules limit how much I can invest in a UK property?

It depends on whether you have domestic ringgit borrowing. Under Bank Negara Malaysia's Notice 3, a resident individual without it may invest in foreign currency assets up to any amount. With it, a limit of RM1 million equivalent per calendar year applies to converted ringgit, with exceptions such as foreign currency funds from outside Malaysia. Your bank applies the rules.

Can I get a UK mortgage while living in Malaysia?

Potentially. It depends on your country of residence, income currency, deposit, circumstances and the property. An FCA-authorised mortgage broker can assess the options and explain the requirements.

Does UK Inheritance Tax apply to my UK property?

Yes. UK property is a UK asset. If you are not a long-term UK resident, Inheritance Tax applies only to your UK assets, at 40% on the part of an estate above £325,000. Malaysia is not on GOV.UK's list of countries with an Inheritance Tax convention.
